Terms of Service The following terms and conditions govern all use of the BlueSkyVault website. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, BlueSkyVault's Privacy Policy) and procedures that may be published from time to time on this Site by BlueSkyVault (collectively, the "Agreement"). If these terms and conditions are considered an offer by BlueSkyVault, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old. 1. Access to your BlueSkyVault account If you create an account on the Website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not describe or assign information to your account in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others. BlueSkyVault may change, suspend or discontinue the Services at any time, including the availability of any feature, database, or content. BlueSkyVault may also impose limits on certain features and services or restrict User's access to parts or all of the Services without notice or liability. 2. Use License a. Permission is granted to temporarily login to BlueSkyVault's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: i. modify or copy the materials; ii. use the materials for any commercial purpose, or for any public display (commercial or non-commercial); iii. attempt to decompile or reverse engineer any software contained on BlueSkyVault's web site; iv. remove any copyright or other proprietary notations from the materials; or v. transfer the materials to another person or "mirror" the materials on any other server. b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by BlueSkyVault at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. 3. Limitations In no event shall BlueSkyVault or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on BlueSkyVault's Internet site, even if BlueSkyVault or a BlueSkyVault authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. 4. Revisions and Errors The materials appearing on BlueSkyVault's web site could include technical, typographical, or photographic errors. BlueSkyVault does not warrant that any of the materials on its web site are accurate, complete, or current. BlueSkyVault may make changes to the materials contained on its web site at any time without notice. BlueSkyVault does not, however, make any commitment to update the materials. 5. Fees; Payment By selecting the service you agree to pay BlueSkyVault the annual subscription fees indicated for that service listed when you signup. Payments will be charged on the day you sign up for a service and will cover the use of that service for a monthly or annual period as indicated. All prices are in USD ( United States Dollars ). 6. Sale of Service We reserve the right to sell or move ownership of BlueSkyVault to a 3rd party without prior notice and without a given reason. 7. Cancellation and Termination You are solely responsible for properly cancelling your account. You can only cancel your account by contacting us via email (support@BlueSkyVault.com). ALL of your content (text and files) will be immediately deleted from the service upon cancellation. This information cannot be recovered once your account is canceled. 8. Indemnification You agree to indemnify and hold harmless BlueSkyVault, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Website, including but not limited to out of your violation this Agreement. 9. Refunds Refunds will be processed within 14 working days from the date of signup. After which refunds will not be processed. Violations of the Terms of Service will waive the refund policy.
